1. Agreement

By using any website, application, or service operated by Moxxai LLC ("Moxxai," "we," "our"), you agree to these Terms of Service. If you do not agree, do not use our services.

2. Services

Moxxai provides custom software development, website design, booking systems, SMS notification platforms, and related technology services to local businesses. Specific service terms, scope, pricing, and deliverables are defined in individual client agreements or statements of work.

3. SMS messaging program

Moxxai operates SMS notification services on behalf of client businesses (e.g., barbershops, gyms) for appointment confirmations and reminders.

• Program description: Appointment confirmations, reminders, and related business notifications.
• Message frequency: Varies by business; typically 1–3 messages per appointment.
• Message and data rates: Standard message and data rates may apply depending on your carrier plan.
• Opt-out: Reply STOP at any time to unsubscribe. You will receive one confirmation message and no further messages will be sent.
• Help: Reply HELP for assistance, or contact us at mox@moxxai.com.
• Supported carriers: All major US carriers. Carrier is not liable for delayed or undelivered messages.

4. Client responsibilities

Clients engaging Moxxai for services are responsible for providing accurate business information, obtaining necessary consents from their customers for SMS communications, and complying with applicable laws including the TCPA and CAN-SPAM Act.

5. Intellectual property

Upon full payment, clients own the custom code and designs delivered as part of their project. Moxxai retains rights to general methodologies, frameworks, and tools developed independently of any specific client engagement.

6. Limitation of liability

Moxxai's liability for any claim arising from our services is limited to the amount paid by the client in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages. Services are provided "as is" without warranties beyond those explicitly stated in client agreements.

7. Governing law

These terms are governed by the laws of the State of California. Any disputes will be resolved in the courts of San Diego County, California.

8. Changes to these terms

We may update these terms from time to time. Continued use of our services after changes constitutes acceptance of the revised terms. Material changes will be reflected with an updated effective date.
